Personal Data Protection

On November 15, 2021, the Law of the Republic of Belarus dated 05/07/2021 No. 99-Z “On the Protection of Personal Data” (hereinafter referred to as the “Law”) came into force, the norms of which are aimed at ensuring the protection of personal data, the rights and freedoms of individuals when processing their personal data.

From this date, all business entities engaged in both commercial and non-commercial spheres (legal entities, individual entrepreneurs, representative offices of foreign companies, etc.) in one way or another interact with the personal data of individuals, including the personal data of their employees, clients of online stores, users of websites and applications, participants in discount programs, which, in turn, creates the need to take appropriate organizational, legal, and technical measures aimed at protecting personal data processed by business entities in the course of business, for the purpose of fair and proper performance of duties provided for by the Law.

For violation of the legislation on the protection of personal data, administrative liability is provided in the form of a fine of up to 200 basic units, depending on the nature of the violation.

In addition, failure to comply with the requirements of the Law, in addition to administrative liability on the part of regulatory authorities, may lead to numerous requests and claims from individuals who are subjects of personal data regarding violation of their rights caused by failure to take measures to protect personal data or excessive processing, which will negatively affect the image and reputation of the company.

In order to identify facts of violation of the Law, the National Center for Personal Data Protection conducts scheduled and unscheduled inspections.
